Fidelização: what you pay to leave a telecom contract early

Calculadora e carta de denúncia

If you cancel internet, TV or mobile before the fidelização (lock-in) ends, the operator can only charge the lower of the contract benefit pro rata to the months left and 50% of the remaining monthly fees (30% from year 2). In some cases you pay nothing, such as an unforeseen move outside the EU or dismissal from your job. Work out the maximum and generate the letter.

DOES ONE OF THESE APPLY?

Cancellation letter: a template ready to copy

Fill in the fields: the letter stays in Portuguese, ready to send by email or registered post. Nothing you type leaves your browser.

Leave empty to end the whole contract: ANACOM treats a request that names no service as covering all of it.
Water: the law asks for it and for access to the meter within 15 days. In Lisbon, EPAL also asks you to be there when the water is shut off.
14 days from receiving the goods, or from signing for a service; 30 days if the contract was signed at your home. The wording follows the official model form (DL 24/2014, annex B).
YOUR LETTER (IN PORTUGUESE)

[…] marks a field still empty. Send it by email to a contact listed in your contract or by registered post with proof of receipt, and keep the proof.

How this works

The calculator applies art. 136(4) and art. 139 of the Lei das Comunicações Eletrónicas (annex to Lei 16/2022), in force since 14 November 2022, and ANACOM’s published reading of them. It covers internet, TV, landline and mobile contracts of consumers and, unless they waived it, of micro and small companies.

  1. 1
Enter the lock-in and the months left
The monthly invoice must show the date the fidelização (lock-in period) ends and the amount due if you leave on that date (art. 122(1)(b) of the Lei das Comunicações Eletrónicas, the electronic communications law). If you only have the dates, the calculator counts the months left and rounds up, so the result is a ceiling.
  2. 2
We apply the two limits of art. 136(4)
    (a) The benefit the contract identifies and quantifies (free installation, discounts), divided by the length and multiplied by the months left. (b) 50% of the remaining monthly fees if you leave in year 1 of the lock-in and 30% in year 2; for a renewal on the same installation, always 30%. The lower figure applies.
  3. 3
With a discounted phone or device, art. 139 applies
100% of the gap between the full price and what you already paid in the first 6 months, 80% after that and 50% in the last year. This is ANACOM’s own example: a €500 phone, €300 paid, at most €200, €160 or €100. Never more than the remaining monthly fees (art. 139(3)).
  4. 4
In a no-charge case, the result is €0
Unforeseen move of your home to a third country, a new home with no equivalent service, dismissal or incapacity with an income drop of 20% or more (art. 133); lock-in already over (art. 132); the operator changed the contract (art. 135); service down for more than 15 days (art. 129).

Worked examples

Four cases with the calculator’s numbers. The first three use art. 136(4); the last is ANACOM’s published example for a discounted phone.

When you pay nothing for the lock-in

In these cases the operator cannot charge for the lock-in. In all of them it can still bill the service you use during the notice period (art. 133(6)).

SituationLawWhat to send
Unforeseen move of your permanent home to a third country (outside the EU)Art. 133(1)(b)Residence certificate there, or a work or service contract there; 30 days’ written notice
New home where the operator cannot provide the same or an equivalent service, in features and priceArt. 133(1)(a)Proof of the new address; 30 days’ written notice
Dismissed by the employer, not your fault, income down 20% or moreArt. 133(1)(c)Unemployment declaration (centro de emprego or Segurança Social) and proof of the drop; 30 days
Unable to work permanently or for more than 60 days, income down 20% or moreArt. 133(1)(d)Proof of the drop (employer, junta de freguesia or bank document); 30 days
Residence moved out of Portugal (EU included): the contract is suspended; after 180 days you can ask for it to lapseArt. 137Notice of the new residence
The operator changed the contract terms and you do not acceptArt. 135Nothing; within 30 days of the notice
Service down for more than 15 days after you reported itArt. 129(5)Proof that you reported it
The lock-in ended and the contract renewed automaticallyArt. 132Nothing; notice of up to 1 month
The operator has no proof you agreed to the lock-inArt. 120(12)Ask for the proof
Death of the account holder (the contract lapses)Civil Code, per ANACOMDeath certificate; no notice period

“Third country” in EU law means a country outside the EU. The law requires the move to be unforeseeable: a move decided long in advance may be disputed by the operator; in that case the art. 137 suspension still applies.

Discounted phone: the art. 139 limits

When the lock-in pays for a phone, tablet or router bought at a discount, the cap follows art. 139, and ANACOM says it cannot exceed the unlocking value. The percentage applies to the gap between the full price and what you have already paid.

When you leave (24-month lock-in)Limit
Months 1 to 6100% of the gap
Months 7 to 1280% of the gap
Last year (months 13 to 24)50% of the gap
After the lock-inUnlocking free, within 24 hours

In lock-ins of 12 months or less, the first 6 months are also the last year. Each point of art. 139(2) is a prohibition, so we use the lower limit (50%); the law does not settle this case expressly. Either way, the amount cannot exceed the remaining monthly fees (art. 139(3)).

What to do with the result

  • The invoice amount is at or below the maximum: choose between waiting out the months left and leaving now. If you switch and port your number, the new operator runs the process, but the exit charge is still owed. Step by step in how to cancel a telecom contract.
  • The operator asks for more: request the itemised calculation in writing under art. 136(4). If it is not corrected, complain in the Livro de Reclamações and take it to a consumer arbitration centre: free for communications services, and the operator must accept it.
  • You are in a no-charge case: pick the reason in the letter generator, attach the documents and send it at least 30 days ahead. For a new home in Portugal, the proof of address page shows which document to use.
  • Leaving Portugal or moving house: internet is one item on the list; power, gas, water, gym and insurance follow other rules. See the checklist in cancelling contracts in Portugal.

Frequently asked

How do I know if I am still locked in?
Check the monthly invoice: the law requires the operator to show how long the fidelização still runs and the amount due if you leave (art. 122(1)(b)). It is also in the contract summary. If you cannot find it, ask the operator or use the cessacaodecontratos.pt platform, logging in with Chave Móvel Digital or Cartão de Cidadão.
How much does it cost to leave a MEO, NOS, Vodafone or Digi lock-in?
The rule is the same for all of them: the maximum is the lower of the contract benefit pro rata to the months left and 50% of the remaining fees in year 1 (30% in year 2). At €40 a month, a 24-month lock-in and 19 months left, the maximum is €380, or less if the contract benefit is lower.
Can a lock-in last more than 24 months?
No. Art. 131(3) bans lock-in periods longer than 24 months in consumer contracts. The only exception is a separate contract just to pay in instalments for installing a physical connection, which cannot include phones, routers or modems.
I am emigrating: do I have to pay the lock-in?
If moving your home to a third country was unforeseeable, you pay no lock-in charges (art. 133(1)(b)): give written notice, email is fine, 30 days ahead, with your residence certificate or work contract there. If you move to another EU country, the contract can be suspended at no cost (art. 137) and after 180 days you can ask for it to lapse.
Can I switch operator during the lock-in?
Yes. Number porting cannot be refused because of a lock-in, and the new operator runs the process, but the exit charge is still owed to the old one, within the legal maximum. Porting only ends the service tied to the number: the rest of a bundle must be cancelled separately.
The operator raised the price: can I leave without paying?
If the operator changes the contract terms, it must give at least one month’s notice and say whether you can end the contract at no cost; you have 30 days after the notice to leave without charges (art. 135). This does not apply when the change only benefits you, is purely administrative or is imposed by law or the regulator.
How do I cancel if I am no longer in Portugal?
By email or letter to any contact listed in the contract: the operator must accept it and cannot demand more than it did to sign you up (art. 136(2)). You can also use the cessacaodecontratos.pt platform or a representative with a power of attorney. Keep proof of sending.

DISCLAIMER
I built this calculator from the text of Lei 16/2022 and ANACOM’s answers, checked in October 2026. It shows a legal ceiling, not the amount your operator will charge, and it is not legal advice: check your invoice and contract summary. The letters are templates; read and adapt them before sending.
